MINUTES OF MEETING
JANUARY 6, 2000

PRESENT:  Chairman Tracy Scott, Ted Bailey, Skip Lawrence, Joanna McIntosh, Pauline Cote, Ron Lesieur, Paul Adams, Harold Arey, Richard DeBold, Andrea Deachman

Chairman Scott introduced the Board and explained how the evening’s agenda would proceed and asked the members of the Board to review the minutes of December 2, 1999.

Motion was made to accept the minutes as written.

PUBLIC HEARING:                 TOWN OF CHICHESTER
                                        ZONING CHANGES

HOME OCCUPATIONS:

#13     HOME OCCUPATIONS PERMITS IN THE CI/MF ZONE WILL MEET THE SAME CRITERIA AS ANY BUSINESS VENTURE WITHIN THE CI/MF ZONE.

Motion was made to accept the change and have it placed on the ballot.

Will be placed on the ballot for the March Town Meeting.

DEAD END ROADS:

There was a concern on limiting extensions to the dead end roads for further development and creating longer dead end roads.  Mr. Mullaney and Mr. Rivere had concerns if the town did not make some exception to the rule when a road would likely be continued on through to a connecting roadway and eliminate the dead end road.

This hearing will be continued to February 3, 2000

BUILDING PERMITS:

The following is a list of persons with concerns and some of the questions asked.  This list may not contain all persons who had comments or address all questions.

John Rivere, Frank Merrill, Jim Mullaney, Mark Drew, Richard Millette, Walter Sanborn, Scott Tepper, Russell MacCleery, R. J. Moreau.

John. Rivere asked: Are existing subdivisions exempt from the ordinance? Per the town council as he understands the RSA’s , No.

Frank Merrill asked: How do you know if the growth ordinance is too low?  Calculations are made using growth in surrounding towns.

Walter Sanborn asked:  Can we reserve permits for residents?  No that would be against the law.

John Rivere comments:  This is unfair to developers and he feels this will bring the property values down.

John Rivere is also upset that he has signed contractual agreements and now he can’t build.

Scott Tepper comments: The town is not responsible for what a contractor signs.

Richard Millett commends the Board and agrees the town needs an ordinance

Russell MacCleery stated he is not against growth just feels it needs to contained so it won’t put a burden on town,

R.J. Moreau comments:  With a restriction the children coming back to town, they will not have a permit to build a house.

Mark Drew stated he feels towns people will be shut out.

The Board commented that this ordinance would be reviewed each year and may only last a short time, the major concern is the large amount of growth in such a short period of time, 5X the average growth rate was hit in 1999.  This should be a concern for all in town and the ordinance will curb the growth not stop it all together or allow it to continue to escalate even further.

Abutters:  None

Mr. Ricker presented the Board with final plans for his subdivision.

After review the Board requested one change.  Note #6 the town name from Canterbury to Chichester.

Abutters:  None

Mr. Ricker presented final plans to the Board for review. The one change on the plan, Note #6 town from Canterbury to Chichester needs to be corrected.

Motion was made to accept the subdivision with the name of the town changed on Note #6 to Chichester.

Abutters:  Joanne Luikmil               

Peter Holden presented the Board with plans for the site.  Bill Rollins, SEA has sent concerns and a letter stating all concerns have been met.

The Board is still concerned with the amount of wet lands on the project.  Mr. Holden explained the detention ponds are to slow the flow of water not contain it.

Joanne Luikmil, abutter is concerned about the brook that feeds her well and what the project will do to the water.  Mr. Holden believes the brook is behind the property line and the project will have no impact on the brook.  Mr. Holden will meet with Mrs. Luikmil to walk the property and see the brook.

DISCUSSION:                     Mike McManus/Pat Leavitt, Owner
                                        Site Review – retail sales – Heavy Equipment
                                        Map 4, Lot 150, Dover Road

Mike McManus presented the Board with plans for the site. There is a temporary driveway permit for the lot now.

Mr. McManus states there are two lots with owners unknown.  Mr. McManus will need to research at the registry of deeds we need to know abutters.

There will be servicing of equipment and the oil will be burned in the furnace.  The Board is concerned about the wash off  to handle oil and grime coming off the vehicles when they are washed, he will need some type of containment unit for this reason possible drains.

The radius of septic and well as to property lines is a concern.

There will be digging and filling in the back part of the property, but the earth will be moved and then returned, like test driving a car.

                                        Map 1, Lot 4, Short Falls Road

Mr. Drew presented the Board with a plan dividing a lot from his property and explained that the lot is larger because of wetlands and additional acreage would make it a buildable lot.

Soil types need to be on the plan and the driveway needs to be on the class V road which is Short Falls Road.

DISCUSSION:                     Fred Bassett
                                        Subdivision
                                        Map 7, Lot 30, Bear Hill & Durgin Road

Mr. Bassett would like to subdivide a 22 acre lot into 5 lots.  After review of the soil types the Board was in agreement that this is wet land and he would need to prove the soil survey incorrect by means of a soil scientist.

Will call when he is ready to continue with the Design Review.

Chairman Scott reopened the meeting at 9:45pm

Chairman Scott will give the towns attorney RSA – 674 pursuant to exemptions.

The Board has requested research on the building permits issued. Andrea will research, we are looking for strictly residential permits of single family dwellings.

The dead end road issue to read:  SECTION IV-

C. DEAD END OR CUL-DE-SAC STREETS SHALL NOT EXCEED 3000 FEET AND SHALL BE REQUIRED TO HAVE A CISTERN(S) OR OTHER ADEQUATE WATER SUPPLY(LOCATION(S) AND SIZE AS DETERMINED BY THE FIRE DEPARTMENT AND OR TOWN ENGINEER) TO PROVIDE WATER FOR A FIRE EVENT. ALL DEAD END ROADS WILL REQUIRE A CUL-DE-SAC OF A LEAST 60 FOOT RADIUS FROM THE EDGE OF THE RIGHT OF WAY.

The Board was in agreement that this is final wording. Public hearing continued to February 3, 2000.
